How to appeal a disciplinary decision

The Building Professionals Board undertakes formal investigations in a transparent and objective manner, in accordance with the principles of natural justice.

If the Board investigates your professional conduct as a certifier, you will always receive a copy of the investigation report for response, before a decision is made.

Once the Board has made a decision, we will notify you (and the complainant, if the investigation was in response to a complaint) in writing, including any disciplinary actions imposed.

Appealing to the Tribunal

You may appeal the decision by applying to the NSW Civil and Administrative Tribunal within 28 days of the date of the Board's determination.

There is no ability for the Board to review its determination of a complaint or investigation matter. There is also no provision for complainants to appeal the Board’s decision.
